ST108: ERCB Monthly Enforcement Action Summary

ST108: ERCB Monthly Enforcement Action Summary has been revised to reflect the prevention and enforcement responses for noncompliance in the most recent edition of Directive 019: Compliance Assurance, effective November 1, 2010. All noncompliance enforcement information reported in ST108 as of this effective date will be now reported under the following compliance assurance categories:
  • High Risk Enforcement Action
  • High Risk Enforcement Action (Persistent Noncompliance)
  • High Risk Enforcement Action (Demonstrated Disregard)
  • High Risk Enforcement Action (Failure to Comply)
  • Low Risk Enforcement Action (Refer Status)
  • Legislative/Regulatory Enforcement Action

Information reported in ST108 has not changed and will be reported as in previous editions. All enforcement actions will continue to be published within 120 calendar days of an enforcement action and posted to the ERCB website on the last Thursday of each month.

Noncompliance information reported in previous editions of ST108 released prior to November 1, 2010, will remain as reported in accordance with the previous edition of Directive 019 under the compliance assurance categories in effect at that time:

  • High Risk Enforcement Action 1
  • High Risk Enforcement Action 2 (Persistent Noncompliance)
  • High Risk Enforcement Action 3 (Failure to Comply or Demonstrated Disregard)
  • Low Risk Enforcement (Global Refer Summary)
  • Legislative/Regulatory Enforcement Action

September 27, 2012. The ERCB is conducting a survey to gain a better understanding of the readership of ST108: ERCB Monthly Enforcement Action Summary report and to gain insight of how the information is being used. In addition, the survey asks questions about publishing the ERCB enforcement advisor’s written decisions as part of the Directive 019: Compliance Assurance appeal process on the ERCB website.
